Foundation law

Foundations have existed in Germany since more than 1,000 years. Foundations are thriving more than ever. At present an average of 1,000 new foundations vested with legal capacity is founded every year. Also the legislator has perceived this new tendency, and through the reform of the common public interest and charity law in 2007, created additional tax incentives so that more and more people consider creating their own foundation when they ask themselves how to protect in the long term - and in particular in case of successions within companies - their aggregate assets while contributing reasonably to society.

Taking into account the individual life situation of our clients, we assist and consult them as regards

  • the decision to create a foundation as alternative way of asset formation,
  • the way of creating a foundation, and in particular the decision in favor of the appropriate form of charity (foundation of common interest, company foundation, family foundation, trust foundation etc.) and on the ideal registered seat of the foundation,
  • the tax advantages and particularities implied in a foundation, and in particular external donations and fundraising.

As a matter of fact we also identify alternative solutions to foundations and consult comprehensively on general legal and tax-related options of fund management.
